2. Legal Nature of the Platform
Growethic, S.L. acts exclusively as a technology service provider. The platform islamicfundraising.com is a digital intermediation tool that facilitates the creation, publication and promotion of fundraising campaigns for charitable, humanitarian and general interest causes.
Growethic, S.L. does NOT intervene in the management, custody, administration or distribution of funds raised through campaigns published on the platform. Donated funds are received directly by campaign organisers through their own payment provider account and do not pass through the accounts of Growethic, S.L. at any point.
The company does not hold the status of credit institution, payment institution, financial entity or financial intermediary under applicable Spanish and European regulations. Its activity is limited to providing technological infrastructure and campaign support services.
islamicfundraising.com is not a non-profit organisation. Donations made through the platform are not managed by Growethic, S.L. and are therefore not eligible for tax deduction on the donors income tax return, unless the campaign organiser is a legally recognised charitable entity and issues the corresponding certificates in accordance with the legislation applicable in their jurisdiction.
3. Payment Processing: Stripe Connect
The platform uses Stripe Connect, a payment processing service provided by Stripe Payments Europe, Ltd. (regulated as an electronic money institution authorised by the Central Bank of Ireland), to technically manage payment flows between donors and campaign organisers.
Under this model:
- Donated funds are credited directly to the campaign organisers Stripe Connect account. The organiser acts as the final recipient and sole responsible party for those funds.
- Growethic, S.L. applies an application fee mechanism to each transaction, corresponding to the voluntary contribution that the donor may optionally add at the time of donation to support the sustainability of the platform.
- This voluntary contribution (hereinafter, "platform tip") is automatically separated in real time at the moment of payment and credited to the balance of Growethic, S.L.
- The amount donated to the cause and the platform tip are technically independent and processed simultaneously in a single transaction, ensuring transparency for the donor.
- Funds raised through a campaign may only be transferred to a bank or payment account held in the name of the registered organiser. Transfer of funds to third-party accounts other than the verified organiser is not permitted under any circumstances.
Payment data (card numbers, banking details) are processed exclusively by Stripe under its own security and privacy standards (PCI DSS Level 1). Growethic, S.L. does not store, process or have access to donors full payment data.
4. Identity Verification (KYC) and Campaign Activation
In compliance with anti-money laundering and counter-terrorism financing regulations, and in accordance with Stripe Connects terms of use, all campaign organisers wishing to receive funds through the platform are subject to an identity verification process (Know Your Customer, KYC) managed directly by Stripe.
The campaign activation process follows these steps:
- Step 1, Registration: the organiser creates an account on islamicfundraising.com providing their identification details.
- Step 2, Campaign creation: the organiser creates their campaign, setting out the objective, description, images and fundraising goal. The campaign enters a pending review status.
- Step 3, Review by the team: the Growethic, S.L. team reviews the campaign content to verify that it complies with these terms of use and the platforms criteria.
- Step 4, KYC verification: once the campaign content is approved, the organisers identity verification process begins through Stripe Connect. This includes verification of the legal representatives identity (name, date of birth, identity document), registered address verification, declaration of economic activity and account purpose, and any additional documentation Stripe may require based on the volume of funds managed.
- Step 5, Activation: if both the campaign content and the KYC process have been completed satisfactorily, the campaign is activated on the platform and the organiser may begin receiving donations.
No campaign may receive donations until all of the above steps have been completed and the campaign has been expressly activated by the platform.
Growethic, S.L. reserves the right to reject or suspend campaigns whose organisers do not satisfactorily complete the Stripe KYC verification process, or where there are reasonable grounds to believe that funds may be used for unlawful purposes.
The platform only accepts campaigns promoted by individuals or entities legally registered in a European Union member state. Campaigns from organisers with a registered office or tax domicile outside European territory will not be accepted.
5. Suspension of Active Campaigns and Refund of Donations
Growethic, S.L. reserves the right to suspend or cancel any active campaign in the following circumstances:
- When a substantiated complaint is received from a donor, beneficiary or third party regarding the use or destination of funds raised.
- When there are reasonable grounds to suspect fraud, misuse of funds, breach of these terms of use or unlawful conduct by the organiser.
- When required by a competent authority or court order.
In the event of suspension or cancellation of an active campaign for any of the above reasons, Growethic, S.L. will, to the extent technically possible and in coordination with Stripe, manage the refund of donations received to the affected donors. The organiser shall have no right to claim compensation for the cancellation of the campaign in these circumstances.
For traceability, audit and legal compliance purposes, a campaign that has been active and has received donations cannot be permanently deleted from the system. It may be suspended, archived or marked as closed, but the associated records will be retained in accordance with applicable legal retention periods.
6. Conditions of Access and Use
Accessing and using islamicfundraising.com implies full and unconditional acceptance of these Terms of Use in the version published at the time of access. The user is responsible for reading and understanding these terms before using the platform.
6.1. General obligations of users
- Use the platform exclusively for lawful purposes and in compliance with applicable legislation.
- Not publish or disseminate false, misleading, discriminatory, offensive or rights-infringing content.
- Not interfere with the technical operation of the platform or attempt to access unauthorised systems or data.
- Provide accurate and up-to-date information during registration and campaign creation.
6.2. Specific obligations of campaign organisers
- Apply all funds raised to the purpose declared in the campaign published on the platform.
- Provide Growethic, S.L. with the information and documentation necessary for the publication of the campaign, including logo and corporate materials when requested.
- Issue, upon closure of the campaign, a certificate or report evidencing how the raised funds were applied, available to Growethic, S.L. and to donors who request it.
- Successfully complete the KYC verification process required by Stripe Connect prior to campaign activation.
- Declare and fulfil their tax obligations arising from the receipt of funds in the jurisdiction in which they are tax-resident.
- Not use funds raised for purposes other than those described in the campaign without prior communication and approval from Growethic, S.L.
- Be legally registered in a European Union member state. The platform does not accept organisers with a registered office or tax domicile outside European territory.
7. Use of Images and Third-Party Rights
The campaign organiser is solely responsible for the audiovisual content (photographs, videos, images or other graphic materials) published on the platform. In particular:
- The organiser declares and warrants that they hold all necessary copyright, image rights and authorisations over the published materials, including the image rights of any persons appearing in them.
- Where images or videos feature minors, the organiser declares that they have obtained express authorisation from their parents, legal guardians or representatives, in accordance with applicable child protection legislation in the organisers jurisdiction.
- Publishing images of third parties without their explicit consent is expressly prohibited, as is using copyrighted images without the appropriate licence.
- Growethic, S.L. is exempt from any liability arising from the improper use of images or materials by the organiser, who shall be solely responsible to any third parties, authorities or claimants.
8. Limitation of Liability
Growethic, S.L., in its capacity as a technology service provider, is expressly exempt from liability in the following cases:
- The final use made by the organiser of the funds raised.
- The organisers failure to fulfil their tax, legal or any other obligations.
- Claims from third-party beneficiaries or donors arising from the application of funds, over which the platform exercises no control.
- Interruptions, technical failures or service unavailability caused by circumstances beyond the reasonable control of Growethic, S.L., including failures in third-party systems such as Stripe.
- Direct, indirect, incidental or consequential damages arising from the use or inability to use the platform.
- Variations in amounts received by the organiser due to commissions, exchange rates or other deductions applied by Stripe or intermediary banking institutions.
The limitation of liability of Growethic, S.L. extends equally to the social media channels and communication channels used to promote campaigns published on the platform.
9. Taxation
Each party involved on the platform is responsible for fulfilling their own tax obligations:
- Donors: donations made through the platform may be subject to the tax benefits or limitations established by the legislation applicable in the donors country of residence. Growethic, S.L. does not advise on or guarantee the tax deductibility of any donation. Donations made through islamicfundraising.com are not deductible on the donors income tax return, unless the campaign organiser is a legally recognised charitable entity and issues the appropriate certificates in accordance with the regulations of their jurisdiction.
- Campaign organisers: receipt of funds through the platform is subject to the tax regime applicable to their legal status and tax domicile. Third-sector entities, foundations and associations must comply with the tax legislation of their country.
Growethic, S.L. will provide the Spanish Tax Agency (AEAT) and any other competent authority with any information requested in the exercise of their inspection and control functions.
10. Authorisation to Use Corporate Image and Assignment of Rights
By publishing a campaign on the platform, the organiser expressly authorises Growethic, S.L. to:
- Reproduce and use their name, logo and any distinctive signs in advertising and promotional activities related to the campaign, in any medium or communication channel (television, internet, social media or others), worldwide, for the duration of the campaign and for two years following its conclusion, without entitlement to additional remuneration.
- Create advertising and communication materials for the promotion of the campaign, the ownership of which shall vest in Growethic, S.L., with all exploitation rights assigned exclusively to Growethic, S.L.
This authorisation may be revoked at any time by written notice to info@islamicfundraising.com. Revocation shall not affect uses already made. If revocation causes harm to Growethic, S.L., the organiser shall be liable for any proven damages.
11. Intellectual Property
All content on the platform islamicfundraising.com (design, source code, texts, images, logos, brand and other elements) is owned by Growethic, S.L. or by third parties who have authorised its use, and is protected by Spanish and international intellectual and industrial property legislation.
Reproduction, distribution, transformation or public communication of such content without the express written authorisation of Growethic, S.L. is strictly prohibited.
12. Personal Data Protection
The processing of users personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and applicable national data protection legislation.
The data controller is Growethic, S.L. For detailed information on the processing of personal data, purposes, legal basis and the exercise of rights, users are referred to the Privacy Policy available on the platform.
Payment data is processed exclusively by Stripe under its own security standards (PCI DSS), and Growethic, S.L. does not store or have access to users full card data.
In the exercise of their inspection, control or investigation functions, Growethic, S.L. will provide competent authorities (including data protection authorities, tax agencies, law enforcement or judicial and administrative bodies) with all information and documentation requested, in compliance with applicable legislation and without this constituting a breach of these terms.
13. Modifications and Suspension of Service
- Growethic, S.L. reserves the right to modify these Terms of Use at any time by publishing the updated version on the platform. Continued use of the platform following the publication of modifications constitutes acceptance of the new terms.
- In cases of force majeure, serious breach by the organiser, or legal requirement, Growethic, S.L. may suspend, modify or cancel campaigns without liability.
- The nullity or invalidity of any clause of these terms shall not affect the validity of the remaining provisions.
14. Alternative Dispute Resolution
The platform islamicfundraising.com is a member of Confianza Online (a non-profit association registered in Spain, CIF G85804011, Calle la Palma 59, Bajo A., 28015 Madrid, phone (+34) 91 309 13 47, www.confianzaonline.es).
In compliance with alternative dispute resolution legislation, users may contact Confianza Online for the alternative resolution of disputes. Claims relating to electronic consumer transactions or data protection will be handled by the Confianza Online Mediation Committee. Claims relating to digital advertising will be referred to the AUTOCONTROL Advertising Standards Jury.

15. Applicable Law and Jurisdiction
These Terms of Use are governed by Spanish law. For the resolution of any dispute arising from access to or use of the platform, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Barcelona (Spain), waiving any other jurisdiction that may apply to them.
